The negligence or recklessness of a driver, premises owner, product manufacturer or animal owner can kill. The estate of the deceased, and the deceased’s parents if he or she was a minor, may be entitled to compensation for any bills resulting from the initial injury and subsequent death. However, surviving family members are also entitled to monetary compensation for their loss. This is what the law refers to as wrongful death damages – also sometimes referred to as loss of society or loss of consortium. The next of kin may be entitled to compensation for the monetary support the deceased would have provided had he or she lived, i.e. when a minor child losses a wage earning parent. They may also be compensated for loss of the love, companionship and guidance that the decedent would have provided.
